iTunes, iPod and Legally Purchased Music

(NewsTarget) An open letter posted Tuesday on Apple, Inc.'s web site from CEO Steve Jobs called for music purchased online to be freed from Digital Rights Management file encryption.

Jobs said that music companies require the use of DRM in music purchased online for any online store that sells music downloads, but Apple would embrace the removal of DRM "in a heartbeat," allowing users to use the music they download any way they like, which is currently not the case.

His company, Apple, is the creator of iTunes, an online music store that allows users to buy DRM-encrypted songs. Unless you use a DRM stripper to modify the files, the songs you buy in iTunes can only be used on five computers and with Apple's proprietary iPod player. They can not be played on a CD player.

Sony and Microsoft have different but also proprietary systems of DRM that require the use of their music players.

In the letter, Jobs said that the other two options he foresees are that proprietary rights management systems will continue to be in place – meaning nothing will change – or that Apple might license its DRM encryption software, FairPlay, to other companies. Jobs dismissed the latter idea because Apple would not be able to "guarantee to protect the music it licenses from the big four music companies," Jobs wrote.

Jobs questioned the use of DRM altogether, as most songs are collected other ways. Only 3 percent of the songs on the average iPod was purchased in the iTunes store, according to Apple's research. The rest came from copying the music from CDs, illegal downloads or other methods of getting songs.

Jobs also argued that, unlike DVDs, nearly all CDs physically purchased by consumers contain no DRM restrictions.

The few times that music companies tried to insert DRM software in CDs, a wide consumer backlash followed. The most notable incident was in 2005 when Sony found it had to recall more than 50 different albums that contained DRM software as consumers balked at the fact the CD they purchased wouldn't play in a normal CD player. At the end of January 2007, the Japanese media giant settled with the U.S. Federal Trade Commission over violations of federal law, and agreed to reimburse customers up to $150 in damages each.

Critic of DRMs and consumer health advocate Mike Adams said that the restrictions go too far.

"DRM has turned consumers into criminals," he said. "By using police state tactics and criminalizing their best customers, music companies and the Recording Industry Association of America have declared war on the very people who actually buy their music. They've lost credibility, customer and goodwill. They can regain that goodwill today by abandoning DRM technology and restoring freedom to music consumers."

Online civil liberties groups like the Electronic Frontier Foundation also criticize the use of DRM. In Europe, some court systems have sought to stop the use of DRM, challenging it as anti-competitive by limiting songs bought online to certain proprietary music players.

In the past, hacking attempts to break through Apple's FairPlay system have had limited success: the once-popular DRM-stripping program JHymn, which converts music bought on iTunes and converts them to freely distributable MP3s, was defeated by new software changes to iTunes by Apple. JHymn's current equivalent is myFairTunes6, which is compatible with the latest version of iTunes.

Along with the EFF, one group leading charge against DRM is the Free Software Foundation, which set up an international day of protest against DRM on October 3, 2006.

Jobs, with Steve Wozniak, is a co-founder of Apple Computer – now Apple, Inc. as of January 2007 – a consumer electronics company started 30 years ago.

iPod versus Zune

iPod has been the master of the MP3 player world for several years now but of course Zune was introduced in recent months. Both are solid contenders in the MP3 corner of the home electronics world so buyers now have a choice.

With choice sometimes comes confusion for buyers.

The decision as to which MP3 player is the better buy is completely dependent upon the individual consumer's preferences. Price is not a deciding factor between the two as both iPod and Zune have 30GB models which come in at $249. As a result there are basically 5 questions that need to be answered to determine a buyer's top priorities and whether iPod or Zune is the device of choice.

• Is a huge capacity/storing the most songs possible critical?

For now iPod has more options than Zune, with Shuffle, Nano, and others including models with 60 and 80GB capacities while Zune currently offers only the 30GB model.

• Is playing video on an MP3 player one of the most prized features?

If the answer is yes, Zune may have a bit of an advantage as it boasts a larger screen. The 2.5" iPod screen is noticeably smaller than Zune's 3.0" screen. Both offer the same resolution; 320x240 and the same aspect ratio: 4:3.

• Is having the smallest, lightest possible MP3 Player a goal?

If tiny is a top priority then iPod will be more attractive as it is thinner, shorter, and lighter than the current Zune offering.

For the selection of downloads, iPod is the champ offering the largest bank of music from which to select. The Zune store offers 2,000,000 titles while iPod offers in the neighborhood of 3,500,000. Unlike current iPod models, Zune is WiFi enabled although it is limited. With Zune users can share a song with someone nearby. The person receiving the song can listen to it for 3 days but then must buy it to continue to enjoy the song. Unfortunately, Zune is still unable to sync with a PC. It may not be much, but if sharing is important, Zune is a step ahead.

It's been many generations now since radio was born. A crackling signal carrying serial dramas and comedies, news, and live concerts entered the living rooms of families across the globe in the early days. Later, the enjoyment of music and talk could be enjoyed on portable transistor and car radios as people went about their business or at least until the weather or distance eliminated the signal.

Over the years however, radio started to fade as an entertainment medium as crystal clear digital music offered front row type listening for music lovers with portable CD, DVD, and MP3 players for their home and travels; no commercials to interrupt the enjoyment and no fading signal. As the tastes of listeners expanded, a dozen or so receivable stations could no longer deliver the diversity of programming that was desired. For some, the regulations of the FCC also quelled some of the "edgier" entertainment that they craved.

Although the uninterrupted, superior audio quality of pre-recorded music has drawn many away from radio listening, the depth of the entertainment experience can be lacking. Switching to a news or weather broadcast for updates, taking in an in depth discussion on a topic of interest, or enjoying a good laugh with a favorite show simply isn't part of the experience. Discovering new artists or favorite genres is also less likely unless a friend shares something new.

Get started in software-defined radio with a project that can tune in two FM stations at once.

My article “GNU Radio: Tools for Exploring the Radio Frequency Spectrum” [LJ, June 2004] provides an overview of how the GNU Radio system works and discusses a couple hardware options for getting the RF signals digitized and into the computer. This article takes a look at how to use GNU Radio to listen to FM radio.

Our setup consists of a conventional FM dipole antenna, a cable modem tuner module mounted on an evaluation board and a 20M sample/second PCI analog-to-digital converter (ADC) card. The antenna plugs in to the input of the tuner module. The tuner module IF output is connected with a piece of coaxial cable to the ADC input on the back of the computer. The tuner module eval board is connected to the PC's parallel port so that we have a way of controlling the module.

The specific hardware we're using is a Microtune 4937 DI5 3X7702 cable modem tuner module and a Measurement Computing PCI-DAS 4020/12 ADC board. This particular tuner module is hard to get, but others, such as those from Sharp Microelectronics, ought to work fine (see the on-line Resources section).

The cable modem tuner functions as our RF front end and is responsible for translating the radio frequency signals that we're interested in down to a range that our ADC can deal with. In this case, the module translates a selectable 6MHz chunk of the spectrum in the range of 50MHz–800MHz down to a 6MHz chunk centered at 5.75MHz. Within six months, Spears is married; three smash (and a few not so) hits, a moderately successful fragrance, and a crashing five-episode reality show failure later, Britney gives birth to baby Sean Preston Federline.

And though Britney has purportedly an “Original Doll” album in the making, clearly suggesting her awareness that her Lolita image is what works (or worked best), it is that image that has incurred the disdain of many: Governor Robert Ehrlich’s wife, First Lady Kendel, would “like to shoot Britney Spears;” is questioned as a fit role model; and is, of course, likened to Madonna—though she is far less the savvy and knowledgeable one, and cannot claim anywhere near the struggles and creative challenges Madonna has earned the right to.

So, consider the latest kinds of coverage on Britney Spears: first, while a star-search online usually yields a Wikipedia entry on page one of Google, for example, when you search for Britney Spears, the wiki entry shows up half way down page two. Hmmm. Next, in the latest edition of Us Weekly (which is generous with Jessica Simpson shots or plastered with Angelina Jolie articles and features), the items that appear on Brit involve 1) a photo of her in a food-stained dress, which she wore, Us said, on March 14; 2) a photo of her coming out of a gas station bathroom sans shoes, August 04 [also shown in earlier grocery store rags, btw].

But where are the shots of the baby? In that same issue, motherhood (and father hood) is a predominant theme—a three-paged bit is done on Angelina Jolie, featuring a full-paged and an additional inset photo of Jolie with newly adopted Zahara; centerfold “Mommy & Me” photographs appear with Liv Tyler, Kate Moss, and Denise Richards hanging out with their kids; and in “The Stars are Just Like Us!” we even see monumental stars like the great Dustin Hoffman taking his son to a NY Nicks game.

So is lack of baby evidence to protect the baby as well? Is it to protect and endure Britney’s teeny-bopper image? Is it to protect the hearts of the wishful thinking fans who fantasize being with Britney without baby or happily married mate in tow? It may be we will never know, as the line between popularity (candid, serendipitous coverage) and publicity (intentional stagings) is paper thin.

Guide To Download Music and Video's to Your PSP

Congratulations on buying that new PSP. You bought some great games with your new PSP and to play them, all you need do is slip a cartridge in the slot and your good to go. Sweet, isn't life great. Hey, how about playing some of your favorite songs or watching one of your music videos on your new favorite toy. Oh! Oh! The store didn't have a cartridge for that! Now what? Don't panic, just follow the step-by-step instructions below and life will be sweet again.

To download music to your PSP you will need to follow these steps.

*Note* Please jump ahead to step #4 if you already have Music - MP3 files located on your computer.

Definitions

CD Ripper Software - Software that extracts (rips) music/mp3 files from your CD and puts them in another file on your computer's hard drive.

PSP Video Converter - Converts your personal computers (PC) video/movie format files into Sony's PSP video/movie format so that you can view them on your PSP.

USB Cable - Cable used to connect peripheral equipment such as camera's, external hard drives and PSP's to your computer's USB port.

1) Put your music CD (the one with the songs you want converted) into your PC's CD drive. Start-up your CD Ripper software or PSP Video Converter.

2) Choose the songs you want to extract to your PSP and select "Extract & Encode". This will convert the selected songs PSP format and transfer them to a file on your PC's hard drive.

*Note* If you have music and/or video files already on your computer's hard drive then all you need to do is select "ADD" from your PSP Video Converter or CD Ripper software.

3) Using the USB Cable, connect your PSP to your computer.

4) Turn on your PSP and select "USB Connection" on your PSP. Your computer will automatically detect the new USB device connected to it and designate a new drive letter, usually E:, but not always. You can check in "My Computer" to be sure.

5) Create a new Folder (name it Music or Videos) under the E: drive or whatever letter your PSP was designated. This new folder will actually be your PSP.

6) It's time to start downloading your music and/or video files from your computer to your PSP.

7) That's all there is to it. After you have downloaded all of your favorite video's and music, disconnect the USB cable and you're good to go.

In a conference call interview with Free Software Foundation Executive Director Peter Brown and DefectiveByDesign campaign manager Gregory Heller, lawyer Ray Beckerman charged the Recording Industry Association of America of terrorizing alleged file-sharers with lawsuits.

Beckerman, who runs the blog "Recording Industry vs. the People," is a New York attorney who represents regular people who have been targeted by the RIAA lawsuits. During his interview, he lambasted the organization for its methods.

"You have a multi-billion dollar cartel suing unemployed people, disabled people, housewives, single mothers, home healthcare aids, all kinds of people who have no resources whatsoever to withstand these litigations," Beckerman said. "And due to the adversary system of justice the RIAA will be successful in rewriting copyright law, if the world at large, and the technological community in particular, don't fight back and help these people fighting these fights."

One of Beckerman's biggest criticisms is the way investigations of file sharing are carried out, and the invasions of privacy that can accompany such inquiries. According to Beckerman, a RIAA investigator poses as a file-sharing-network user, tracks down a folder containing a suitable number of copyrighted songs, and takes a screen shot of the folder, assuming it is one big, shared folder. What the investigator does not do, Beckerman said, is discover whether the songs were obtained legally, through paid downloads, personal copy of an owned CD, or some other method; whether the files have ever been copied or used illegally; or reveal his method of association the file with a dynamic IP address.

The next step is for the investigator to go to the IP to obtain a name and address for the subscriber who paid for the connection, but Beckerman said that person is not necessarily the person who downloaded the files. "But once (the investigator) gets that information he then sues the person," he said.

Beckerman has been able to fight a few cases brought on by what he calls a "John Doe" process, but said that many judges do not understand the cases. He recalled a 2004 case in which an elderly judge was falsely informed by the RIAA that the metadata and the hash was enough to identify files that were copied illegally, and referred to that information when upholding the RIAA subpoena.

"We've tried to point out in our John Doe cases that the technical underpinning of the investigation is meaningless, that the metadata doesn't tell you anything, that it can be scrubbed, that it can be changed, that any real pirate would never leave the metadata of the thing he had purloined," he said. "The metadata tells you nothing, the hashmarks do not conclusively establish anything. Even seeing the shared files folder doesn't tell you which computer it resided on because all of these networks use one form or another of a hierarchy of computers ... so that when you see the shared files, all you're seeing is metadata from one computer or from a group of computers that are connected to one node, but the judges have no clue."

A break in the pattern has come in a case called Electro vs. Barker, in which a nursing student was sued for file sharing, but the complaint did not cite specific acts, dates, or times of copyright infringement. In this case, the RIAA has claimed that making files available on the internet is a copyright infringement.

"It was a shocking argument because if it were accepted it would probably shut down the entire internet," Beckerman said. The claim drew support for both sides, as Barker received support from some organizations in the form of an amicus curiae brief (volunteered information of an aspect of the case from a party not involved in it) and the RIAA received the backing of the Motion Picture Association and, to a lesser degree, the U.S. government. "If our motion to dismiss is granted and sustained on appeal it would mean the end of the RIAA juggernaut against innocent people not known to have committed a copyright infringement."

Unfortunately, Barker's extremely limited financial resources may upend the dismissal.

"Unless the world comes together and helps these defenseless people the RIAA is going to win all these battles one way or another and they're going to rewrite the copyright law," Beckerman said.

Taking on the record industry

SINCE 2003 THE Recording Industry Association of America (RIAA) has filed almost 15,000 lawsuits charging computer users with trading music online. Now one of its targets is suing back. Tanya Andersen, a 42-year-old disabled single mother, has filed a countersuit in Oregon alleging that the industry's practices violate, among other laws, the state's Racketeer Influenced and Corrupt Organizations Act.

Last February, Andersen got a letter from a Los Angeles law firm informing her she was being sued for copyright infringement. MediaSentry, an investigator retained by the recording industry, had allegedly caught her collecting gangsta rap on her hard drive late one night using peer-to-peer file sharing software. Andersen's attorney, Lory R. Lybeck, says Andersen doesn't know how to use such software--indeed, that she doesn't even like gangsta rap.According to Lybeck, when Andersen tried to protest her innocence and offered up her computer for forensic analysis, she was told that the suit had to continue or others might be deterred from settling.

If Andersen really is being falsely charged, she probably isn't unique. In October attorney Ray Beckerman, who is defending another single mother against an RIAA suit, told Wired News he believes thousands of defendants may have been falsely accused. As Electronic Frontier Foundation Legal Director Cindy Cohn points out, investigators may incorrectly link file lists to Internet protocol addresses, and cable companies have been known to incorrectly link IP addresses to customers. Furthermore, as home and cafe wireless networks become more common, there's no guarantee that the customer was the one sharing music.
